Welcome to nadinenaue.com. These Terms & Conditions (“Terms”) govern your use of this website and your purchase or use of services, memberships, digital content, and other offerings provided by Nadine Naue (“Nadine Naue,” “I,” “me,” or “my”).
By accessing this website, purchasing a service, joining Capsule Icons, booking a Style Power Hour, or otherwise using my offerings, you agree to these Terms. If you do not agree to these Terms, please do not use the website or purchase or access the applicable offering.
1. ELIGIBILITY
This website and its paid offerings are intended for individuals who are at least 18 years old.
By making a purchase, you represent that you are at least 18 years old and legally able to enter into these Terms.
2. CAPSULE ICONS MEMBERSHIP
Capsule Icons is a personal style membership providing educational content, style guidance, seasonal curation, shopping resources, videos, workbooks, guides, coaching, and other membership materials.
Membership content and features may evolve over time as Capsule Icons is updated and refined.
Membership Options
Capsule Icons is currently available as:
$997 billed annually; or
$97 billed monthly.
Both options are recurring subscriptions and automatically renew at the selected billing interval unless canceled.
Prices and membership offerings may change in the future. Any applicable pricing and billing terms presented at the time of purchase will govern that purchase.
Automatic Renewal
By purchasing a Capsule Icons subscription, you authorize the applicable recurring charge to your selected payment method at the billing interval you choose until you cancel your subscription.
The annual membership renews annually, and the monthly membership renews monthly, unless canceled before the next applicable renewal charge.
Cancellation
Members may cancel their Capsule Icons subscription at any time through the applicable customer account or subscription management functionality provided through the website or payment platform.
Cancellation stops future renewal charges. It does not retroactively cancel or refund a membership period that has already been paid for.
When a member cancels, access will continue through the end of the current paid billing period. Membership access will then expire.
It is the member’s responsibility to cancel before the next renewal charge if the member does not wish to renew.
No Refunds
Capsule Icons membership payments, including initial payments and renewal payments, are non-refundable once charged, except where a refund is required by applicable law.
Because members receive immediate access to digital materials, educational resources, curation, and other membership content, refunds will not be provided because a member changes her mind, does not use the membership, does not access available content, or later decides the membership is not the right fit.
Access After Cancellation
Once a member’s paid membership period ends, access to Capsule Icons and its member-only content will end. This includes, without limitation, the Archive, Seasonal Style Editions, Trend Reports, videos, shopping links, style resources, coaching materials, and other member content.
Members may retain copies of downloadable or printable resources they legitimately downloaded or printed during an active membership, including the Discover Your Style Persona workbook and Closet Edit Guide, solely for their own personal, non-commercial use.
Retained materials may not be shared, copied for others, distributed, published, uploaded, sold, reproduced, or otherwise made available to another person.
Account Sharing
Capsule Icons membership is for the individual purchasing member only.
Members may not share account credentials, login access, member-only shopping links, videos, guides, workbooks, Seasonal Style Editions, Trend Reports, coaching materials, or any other membership content with another person.
I reserve the right to suspend or terminate access if I reasonably believe an account or membership materials are being shared or used in violation of these Terms.
3. STYLE POWER HOURS
Style Power Hours are private styling sessions available exclusively to active Capsule Icons members and are purchased separately from the membership.
The current price of a Style Power Hour is $350 unless otherwise stated at the time of booking.
Style Power Hours are non-refundable.
Appointments may be rescheduled with at least 24 hours’ notice. Requests to reschedule with less than 24 hours’ notice may be accommodated at my discretion.
Missed appointments and cancellations are not eligible for refunds.
Purchasing a Style Power Hour does not include additional ongoing styling, sourcing, follow-up work, or other services unless specifically stated at the time of booking.
4. THE 1:1 EXPERIENCE
The 1:1 Experience is a personalized styling engagement using the Identity to Icon™ Method and is generally completed over approximately four weeks.
The Experience may include Identity, Edit, Curation, and Integration phases, as applicable to the client’s engagement.
Specific scope, timing, pricing, deliverables, payment arrangements, and other client-specific details may be confirmed separately in writing at the time of booking.
Commitment and Payment
By booking the 1:1 Experience, the client commits to the full Experience and the full agreed fee. Dedicated time is reserved for each client based on that commitment.
Payment may be required in full or, when agreed in advance, may be divided into installments.
An installment plan is a payment accommodation only. It does not divide the 1:1 Experience into separately cancellable services or phases and does not reduce the client’s obligation to pay the full agreed fee.
The entire agreed fee must be paid in full before Phase 4, Integration, including the final styling session.
Specific installment amounts and due dates will be communicated and agreed upon at the time of booking.
Cancellations
Because the 1:1 Experience requires dedicated time to be reserved specifically for each client, bookings are non-cancellable and payments are non-refundable. Once booked, the client remains responsible for the full agreed fee, including any remaining installment payments, even if the client chooses not to complete the Experience, except where otherwise required by applicable law.
A client’s decision not to complete the Experience does not eliminate the obligation to pay the full agreed fee.
Scheduling and Rescheduling
Reasonable rescheduling may be accommodated during the earlier stages of the Experience, subject to availability.
Once the Experience enters time-sensitive phases involving shopping, sourcing, ordering, fittings, retailer return periods, and Integration, the schedule becomes significantly less flexible.
Curation and Integration are designed to take place within an appropriate timeframe so that purchases can be evaluated and, when necessary, returned within applicable retailer return periods.
Rescheduling during these phases is subject to my availability, the progress of the Experience, and applicable retailer return windows. I cannot guarantee that retailer return or exchange eligibility can be preserved when sessions or decisions are delayed by the client.
5. THIRD-PARTY RETAILERS AND PRODUCT RECOMMENDATIONS
I may recommend or link to clothing, accessories, footwear, beauty products, retailers, brands, or other third-party products and services.
Unless expressly stated otherwise, products recommended through Capsule Icons, the 1:1 Experience, Style Power Hours, social media, email, or this website are purchased directly from independent third-party retailers.
I am not the seller of those products and do not control third-party inventory, pricing, shipping, delivery, sizing, product quality, availability, returns, exchanges, refunds, customer service, or retailer policies.
Any transaction with a third-party retailer is between you and that retailer and is subject to the retailer’s terms and policies.
Product availability and prices can change at any time, and I cannot guarantee that a recommended item will remain available or available in a particular size, color, location, or country.
6. AFFILIATE LINKS, COMMISSIONS, AND GIFTED PRODUCTS
Some links shared through this website, Capsule Icons, email, social media, or my other content may be affiliate links.
This means I may receive a commission when you purchase an item through certain links, at no additional cost to you.
Not every link or recommendation is an affiliate link, and the availability of a commission does not guarantee that a product will be recommended.
I may also occasionally receive products as gifts or complimentary products from brands. Where required, applicable affiliate, gifted, sponsored, or other material relationships will be disclosed.
7. INTERNATIONAL ACCESS
Capsule Icons and certain virtual services may be accessed by clients and members outside the United States, subject to internet access, payment processing availability, and any other applicable technological or legal limitations.
Membership materials are provided in English.
Personal 1:1 support may be provided in English or German.
Product availability, retailer shipping, currency, duties, taxes, return policies, sizing, and other shopping considerations vary by country. While many recommended brands may be available internationally, I do not guarantee that every product, link, retailer, or recommendation will be available or practical in every location.
8. EDUCATIONAL AND PERSONAL STYLE DISCLAIMER
The content provided through this website, Capsule Icons, the Identity to Icon™ Method, Style Power Hours, social media, emails, guides, workbooks, videos, coaching calls, and other materials is intended for personal styling, informational, and educational purposes.
Style is personal and subjective. Recommendations are based on professional judgment, experience, information available at the time, and, where applicable, information provided by the client or member.
I do not guarantee that every recommendation, garment, brand, fit, trend, style, product, or purchasing decision will suit every individual.
You remain responsible for your own purchasing decisions, use of recommendations, clothing care, and personal application of the information provided.
9. NO GUARANTEE OF RESULTS
I aim to provide thoughtful, professional styling guidance and tools designed to help clients and members make more intentional wardrobe decisions.
However, individual results vary.
I do not guarantee any particular personal, professional, financial, emotional, social, or other outcome from use of the website, Capsule Icons, the 1:1 Experience, Style Power Hours, the Identity to Icon™ Method, or any other service or content.
10. INTELLECTUAL PROPERTY
All original content and materials made available through this website, Capsule Icons, the Identity to Icon™ Method, the 1:1 Experience, Style Power Hours, emails, social media, and related offerings are owned by or licensed to Nadine Naue and are protected by applicable intellectual property laws.
This includes, without limitation, the Identity to Icon™ Method and its framework; Capsule Icons materials; Seasonal Style Editions; Trend Reports; Discover Your Style Persona materials; Closet Edit materials; workbooks; guides; videos; recordings; presentations; style boards; shopping edits; written content; educational materials; graphics; photographs owned by or licensed to me; templates; and other original materials.
Your purchase or membership gives you a limited, personal, non-exclusive, non-transferable right to access and use applicable materials for your own personal use.
You may not, without prior written permission:
copy or reproduce materials for another person;
share or distribute member-only or client-only materials;
publish or upload materials publicly;
sell, license, sublicense, or commercially exploit materials;
teach, reproduce, or present the Identity to Icon™ Method or proprietary materials as your own;
adapt or use the materials to create a competing or derivative commercial product, service, course, membership, methodology, guide, or program;
remove copyright, trademark, or other proprietary notices; or
permit another person or business to use your access to obtain protected content.
Nothing in these Terms transfers ownership of any intellectual property to you.
11. TRADEMARKS
Identity to Icon™ and other names, marks, logos, program names, and branding used in connection with my business may be trademarks or proprietary brand identifiers of Nadine Naue.
Nothing in these Terms grants permission to use these marks in connection with another business, product, service, course, program, membership, or commercial activity.
12. RECORDINGS AND LIVE SESSIONS
Certain membership coaching calls, workshops, educational sessions, or other group experiences may be recorded and made available to members or participants.
When a session will be recorded, participants may be notified through the applicable platform or session information.
Participants are responsible for deciding whether to participate with their camera, microphone, name, comments, or other identifying information visible or audible.
Recordings and related materials may not be copied, distributed, republished, or shared outside the authorized audience.
13. WEBSITE AND CONTENT AVAILABILITY
I may update, modify, replace, remove, or discontinue website content, membership materials, product recommendations, links, features, or other content from time to time.
I do not guarantee uninterrupted or error-free access to the website, membership platform, third-party platforms, links, videos, or other digital content.
Temporary interruptions caused by maintenance, hosting providers, payment processors, internet providers, software platforms, or circumstances outside my reasonable control do not create a right to a refund.
14. THIRD-PARTY WEBSITES AND SERVICES
This website and my offerings may use or link to third-party platforms and services, including payment processors, retailers, video conferencing platforms, email providers, scheduling services, membership platforms, and social media platforms.
I am not responsible for the availability, security, privacy practices, content, policies, or performance of third-party services.
Your use of third-party services may also be governed by their own terms and privacy policies.
15. PROHIBITED USE
You agree not to use this website, membership, services, or materials:
for unlawful or fraudulent purposes;
to interfere with or disrupt the website, membership platform, or services;
to attempt to gain unauthorized access to another member’s account or protected materials;
to scrape, systematically download, copy, or extract protected content;
to impersonate another person;
to share paid access with unauthorized users; or
in any manner that infringes my intellectual property or other legal rights.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Nadine Bender will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, this website, Capsule Icons, the 1:1 Experience, Style Power Hours, product recommendations, third-party links, or other services or materials.
To the fullest extent permitted by applicable law, my total liability arising from a particular paid offering will not exceed the amount you actually paid to me for that specific offering giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
17. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Nadine Bender from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the website or services, your unauthorized use or distribution of protected materials, your violation of these Terms, or your infringement of another person’s rights.
18. PRIVACY
Your use of this website and my services may involve the collection and processing of personal information.
Please refer to the Privacy Policy for information regarding how personal information is collected, used, stored, and handled.
19. CHANGES TO PRICING, OFFERINGS, AND THESE TERMS
I may change prices, features, offerings, or these Terms from time to time.
Changes to pricing will not retroactively alter amounts already paid. Any pricing applicable to a new purchase or renewal will be communicated as required by applicable law and/or presented through the applicable purchase or subscription process.
If these Terms are materially updated, the revised version will be posted on this website with an updated effective date.
Continued use of the website or applicable services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
20. GOVERNING LAW
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles, except where applicable consumer protection laws or other mandatory laws provide otherwise.
Nothing in these Terms is intended to waive rights that cannot lawfully be waived under applicable local, state, federal, or international law.
21. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
22. ENTIRE AGREEMENT
These Terms, together with any applicable written service details, payment terms, booking confirmations, membership terms, and Privacy Policy, constitute the applicable agreement regarding your use of the website and purchased offering.
For individualized services such as the 1:1 Experience, client-specific written terms concerning scope, pricing, payment schedule, dates, and deliverables may supplement these Terms. If there is a direct conflict concerning those client-specific details, the specifically agreed written terms will govern those details.
